Terms of Service

Welcome to Whalespace International Realty ('Whalespace', 'we', 'our', or 'us'). By accessing our platform or engaging our end-to-end real estate brokerage services, you agree to these Terms of Service.

Whalespace operates as a fully licensed, end-to-end real estate agency in Thailand. Our services include property marketing, buyer/tenant representation, contract drafting, ownership transfer facilitation at the Land Department, and post-sale/lease support. Engaging our services establishes a formal agency-client relationship.

While browsing our platform is free, successful property transactions facilitated by Whalespace are subject to brokerage commissions as outlined in separate Listing Agreements or Buyer Representation Agreements. Reservation deposits (earnest money) paid to secure a property are strictly non-refundable should the buyer/tenant default, but will be refunded or credited if the seller/landlord defaults, subject to the specific reservation agreement.

Never transfer funds directly to an agent's personal bank account. All official Whalespace transactions must be routed through our corporate accounts or directly to the verified property owner as instructed in the official invoice.

Property owners listing with us are subject to the following professional standards:

Verification & Authenticity: Owners must provide valid Title Deeds (Chanote) and identification to prove legal ownership before a listing is published.
Exclusive vs. Open Listings: Properties under an 'Exclusive Agency Agreement' with Whalespace receive priority marketing. Owners must honor the exclusive period and direct all inquiries through Whalespace.
Accuracy of Information: Owners are liable for the accuracy of property defects, dimensions, and legal statuses provided to our agents.
Media Rights: All professional photography and videography produced by Whalespace remains our intellectual property and cannot be used by third-party agents.

Whalespace facilitates property viewings. Clients agree that Whalespace is not liable for any personal injury sustained during a site visit, nor are we liable for any accidental damage caused by a visiting client to a seller's property.

To comply with Thai authorities and international real estate standards, Whalespace requires strict Know Your Customer (KYC) documentation, including valid passports, Thai ID cards, and proof of funds before drafting commercial or residential sales contracts.

Whalespace acts to the best of its professional ability to verify buyers, sellers, and properties. However, we do not guarantee structural integrities or hidden legal encumbrances of properties unless a formal legal due diligence service is explicitly engaged.

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms or our brokerage services shall be subject to the exclusive jurisdiction of the courts of Thailand.
